Well Ron I do have a plan. Since the medical bunch say one year I am having my solicister, attorney for you Americans, open negotiations as to which year. I am willing to go with something like 2035. Failling successful negotiations I am sure he can get the year reduced to eight months...........damn, that is the wrong way. Better contact him again. |

My step mom was told one year several different times. She made it about four or five from diagnosis of advanced colon cancer. I wish you similiar longevity. Get more than a couple opinions on treatment. If surgery isn't a option see if cyber knife is. Best wishes Murf.

" Dear Dr. ? Re: Term Lease, Life of Murray Schmidt I write to renegotiate the terms of the my life lease. At my birth, based on life expectancy tables I was not even assured of outliving my retirement. Not even minimally. By the time I retired, life expectancies for new-borns were being published far exceeding what was offered me. These facts are or should be indisputable. I plead the doctrine of novus actus intervenes on two grounds. Both grounds are part of Canadian legislative history. One is an entrenched constitutional right, the other is statutory. They are the Canadian Charter of Rights and Freedoms (the "Charter") and the Canada Pension Plan ("CPP"). I also plead denial of natural justice – audi alteram partem. Ground One – Raised: The senior authority is the Charter. Section 15 thereof is the equality section. Although arising in our lifetimes, sufficient law has been written on the Charter to permit presumptions to be made. It is not enough to trigger a Charter remedy simply to show that a Plaintiff or Petitioner has been treated "differently". All laws differentiate between people. It must be shown that a legal differentiation has been created or arises that unfairly distinguishes against a legal right before the law or under the law in a manner that is not demonstrably justifiable in a free and democratic society. If such a fact pattern can be established a Charter remedy may flow. Ground Two - Raised: Arising in the 1960’s after I entered the workplace, CPP mandated the involuntary taking from my earnings of sums promised to be returned in my dotage. Ground Three – Raised: Audi alteram partem literally means "hear the other side."
Ground One – Facts in Support: I am a senior. I lived in the days when water was clean and sex was dirty. I passed through Strontium 90, smog and the margarine crisis, all of which were alleged to cause the "Big C". Many people before and after me evidence no indicia of the "Big C". I do. Because of that differentiation you (the medical profession) are demanding an additional tax on my years remaining. Ground Two – Facts in Support: I paid into CPP my working life. Because I paid into CPP I have a pecuniary interest in receiving pension benefits. It is my position that cancelling my lease on life at this time and in this manner is arbitrary. In the Disarmament case in the Supreme Court of Canada, reasons delivered by Madame Justice Bertha Wilson first stated that no law of Canada may act arbitrarily. Section 7 of the Charter "principles of fundamental justice" has since been invoked in support of the prohibition against arbitrariness. Ground Three – Facts in Support: Audi alteram partem literally means "hear the other side." The process in this case went ahead without full notice and argument by me. It is contrary to one of the oldest of the principles of natural justice that I not be permitted a part in the debate. It matters not whether the omission was advertent or inadvertent. The decision in this case was made sans my input. Argument: Pursuant to the Charter I say that I have not been treated equally. My treatment has been arbitrary. I am entitled to hear the case I face and have my argument heard before a final decision is made. Any one of these three errors should be fatal to the decision of the medical profession that I not live on without an end-of-term date. Cumulatively they demand redress. Remedy Sought: In the alternative: An order that the decision be reversed and a full reprieve granted on the grounds that my constitutional rights were violated. An order that the decision to deprive me of CPP benefits was arbitrary and must be reversed. A declaration that the decision was unfair and a re-hearing must be granted after my being given fair chance to reply – say about 15 years. Costs, say enough for a world cruise and a Big Five African safari.
